WELCOME TO THE TRAFFIC/CRIMINAL DEPARTMENT
The Lyndhurst Municipal Court handles traffic cases and misdemeanor criminal cases Monday through Thursday from 8:00 am until 4:00 pm. Arraignment sessions are heard by Judge Mary Kaye Bozza. Magistrate Lisa Obert may occasionally hear cases on Tuesday and Wednesday.
The Court accepts traffic ticket waivers Monday through Friday during regular business hours. The Lyndhurst Police Department accepts waivers after Court business hours.
TRAFFIC TICKET WAIVERS
PAYMENT INSTRUCTIONS FOR AFTER HOUR PAYMENTS
AFTER HOURS, COURT ACCEPTS CHECKS AND MONEY ORDERS. COURT ENCOURAGES YOU NOT TO PAY WITH CASH BECAUSE A DEPUTY CLERK IS NOT AVAILABLE TO VALIDATE YOUR TRANSACTION.
WE ACCEPT PAYMENTS FOR WAIVERABLE TICKETS WITHIN 7 DAYS OF THE DATE OF THE TICKET. WE WILL EXTEND THE 7 DAY PERIOD UP TO THE DAY BEFORE THE COURT DATE PRINTED ON THE TICKET.

General Information
Waiverable tickets (no court appearance required) must pay at the Clerk’s window or send payment in within 7 days from the date the citation was received. The Court accepts in-state personal checks, cash, Visa and Mastercard (credit card in person, cardholder present). Out-of-state people please send money order or official bank check.
Non-waiverable tickets (court appearance required) must appear on the date stated in the bottom right corner of ticket. Please bring all of the following:
1. your driver’s license
2. a copy of the ticket
3. proof of insurance
4. money to pay all fines and costs that day.
If you cannot appear on the stated date, the Court grants an automatic one-week continuance. A defendant must motion the Court in writing to get a continuance beyond the one-week.

OVI/DUI OR ALCOHOL RELATED OFFENSES
A. FIRST OFFENSE
1. 1st Offense in 6 years with a positive BAC test result > .08, 15-day mandatory hard time suspension shall be satisfied.
Or
2. 1st Offense in 6 years with refusal to submit to BAC test, 30-day hard time suspension shall be satisfied.
3. Any refusal must present with assessment. If found to be chemically dependent, offender may be required to have "restricted plates".
4. 1st offense in 6 years with a positive BAC test result > .17 shall be required to have "restricted plates".
B. SECOND OFFENSE
1. 2nd Offense in 6 years with or without BAC test, 30-day mandatory hard time suspension shall be satisfied.
2. A 2nd refusal to submit to a BAC test, 90-day mandatory hard time suspension shall be satisfied.
3. Some cases require 90-day immobilization of the vehicle. This may affect the commencement date of the privileges.
4. All 2nd offenders shall have "restricted plates".
5. All 2nd offenders shall submit to an alcohol assessment and if found to be chemically dependent, offender must participate in treatment as a pre-requisite for driving privileges.
C. THIRD OFFENSE
1. 3rd Offense in 6 years with a positive BAC test result > .08, 180-days mandatory hard time suspension shall be satisfied.
2. A 3rd refusal to submit to a BAC, 365-day mandatory hard time suspension shall be satisfied.
3. Some cases require forfeiture of the vehicle. This may affect the commencement date of the privileges.
4. All 3rd offenders shall have "restricted plates" and "disabling device".
5. All 3rd offenders must participate in a treatment program.
D. ALL REQUEST FOR PRIVILEGES SHALL BE FILED WITH THE COURT IN WRITING AND SHALL INCLUDE:
1. Name, address, date of birth and social security number of defendant
2. Case number
3. Proof of insurance for date of arrest and current insurance information
4. Address of employer
5. Days of the week and hours of employment
6. Filing fee in the amount of $40.00
7. 2nd offenders must present with alcohol assessment and if found to be chemically dependent, offender must participate in treatment program as a pre-requisite to privileges.
8. All 3rd offenders must participate in a treatment program as a pre-requisite to privileges.

STEPS TO GET YOUR VEHICLE RELEASED
1. You must take a copy of the court journal entry that evidences the release of your vehicle to the police department from the city that issued the citation, together with proof of ownership, title or registration.
2. You must obtain a release from the police department.
3. Take police department release to Ken’s Auto.
4. All towing and storage fees must be paid before Ken’s Auto will release the vehicle.

IMMOBILIZATION OF VEHICLE
1. In the event your vehicle was immobilized by Law, you must pay the $100.00 immobilization fee to the BMV in Parma and obtain new license plates.
2. Proof of the above, must be presented to the police department that issued your citation. Obtain release of vehicle from police department.
3. Take police department release and proof of payment of the immobilization fee and new license plates to Ken’s Auto.
4. All towing and storage fees must be paid before Ken’s Auto will release the vehicle.

STEPS
